University President Sues Delta Air Lines for Gun-Related Arrest

The president of the University of Sioux Falls, South Dakota reportedly filed a lawsuit against Delta Air Lines after being arrested on a gun-related charge.

Mark Benedetto spent a night in a New York City jail in October 2011 because he was unaware that it is illegal to possess a firearm in New York. Benedetto claims Delta Air Lines should have informed him of the city´s restrictive gun laws.

"Without warning or explanation, the Delta ticket agent proceeded to notify the New York-New Jersey Port Authority Police via telephone that he had a passenger who had declared a firearm," his lawyer claims.

  Say what?

How is it Delta Air Lines fault? This idiot should know ALL gun laws wherever he goes - ahead of time - or he should not own a gun. What a tool. Bringing a gun to an airport is lunacy.

I think the idea is that seeing as he openly declared possessing it and thus clearly had no intention of trying to sneak it past laws, he should´ve been informed of the reason they were, you know, calling the police on him, to avoid excessive stress and confusion.

That´s like walking into a bank and declaring you have a gun. Check ahead before you haul your heat anywhere you think you can go.

Or all the states should be required to follow 2nd amendment and get rid of the confusion...

I don´t think it´s anything like walking into a bank and declaring you have a gun, actually. Most banks won´t look kindly on this.

But as bala_mt pointed out, tons of /states/ are just fine with you carrying a gun. So it´s more like walking into a bank and finding out that they don´t allow people to wear short sleeved shirts, and you´re arrested for it without even being clearly informed of what the problem is.

I think that the issue is that...

The ticket agent in SD checked his luggage in without a word to him about restrictive gun laws in NY but was aware of them and ratted him out to NY cops.

If she/he knew it was going to be an issue for him then common decency should have lead her/him to warn the guy.

I´m kind of on the fence about gun laws but there are places guns are allowed(in some states) and there are places where their not allowed(in others). No place lets John Q. Public walk into a school with a shotgun. Are the schools denying citizens 2nd amendment rights? Maybe. And I wouldn´t have it any other way.
